Cookie Law
April 2012
The law which applies to how you use cookies and similar technologies for storing information on a user’s equipment such as their computer or mobile device changed on 26 May 2011 meaning website owners could face hefty fines if they’re not compliant.Cookies are one way a website can identify a user, e.g. most eCommerce sites use them to keep track of what you’ve added to your shopping basket.
In 2011 the Information Commissioners Office introduced new legislation, at the request of the EU, to regulate the use of cookies. From 26th May 2011, any cookie which is not required for your site to function must be opt-in, rather than opt-out. In practice this means that most eCommerce websites that use cookies (which are most eCommerce sites) should add a message on the ‘basket’ page making visitors to the site aware of the cookies that you are storing on their machine, as well as why.
When the law came in to effect in 2011, the ICO granted a 12 month grace period to website owners, realising that the change would take some time to implement. This grace period ends on the 26th May 2012, and with the threat of fines up to £500,000 it’s a good idea to make sure you’re compliant.
Compliancy depends on exactly what your website does and how it achieves it, but at the very least you need an easily accessible list of cookies, and their function, somewhere on your website for your users to read. If you have cookies which are not required for your site to function (e.g. Google Analytics), you should get explicit consent from your users before setting the cookie.
The ICO has issued guidance on this: http://www.ico.gov.uk/for_organisations/privacy_and_electronic_communications/the_guide/cookies.aspx
As ever, if you’re in doubt as to whether or not your website is compliant, or if you would like some assistance to bring your website in line with the legislation, then please contact us.

Web economy 'to double by 2016', Google says
The value of the web economy in G20 countries will nearly double by 2016.Driving the spurt from $2.3tn (£1.5tn) to $4.2tn (£2.7tn) will be the rapid rise of mobile internet access.
The study, supported by web giant Google, assumes that in four years 3bn people will be using the internet, or nearly 50% of the world's population. The research suggests that the UK is one of the most advanced e-commerce economies. Right now, every year about 200 million people are going online for the very first time. However, traditional internet access via a copper wire and a desktop PC will fade into the background. The rapid fall in the cost of smartphones - with cheap versions now costing about $100 - means that by 2016 about 80% of all internet users will access the web using a mobile phone.
The research does not even account for web access using so-called feature phones. Source: BBC
